Felony vs. Misdemeanor Charges

All criminal offenses may be classified as misdemeanors or felonies, based upon the penalties that may be imposed upon a conviction for that offense. In California, a misdemeanor is a crime punishable by up to 1 year in county jail. A felony is a more serious offense that may be punishable by anywhere from 1 year to life in state prison. The death penalty may be imposed for a capital felony conviction (such as for first degree murder). Another factor that makes felony charges so serious is the fact that a conviction may result in a "strike" on a defendant's criminal record if the offense is considered a "serious" or "violent" felony.

Some examples of crimes typically charged as misdemeanors include: petty theft, first-time DUI, drug possession, domestic violence, simple assault and battery and indecent exposure.

Some examples of crimes typically charged as felonies include: residential burglary, armed robbery, drug trafficking, assault with a deadly weapon, grand theft, manslaughter, forcible rape and murder.

Many criminal offenses may be charged as felonies or misdemeanors, depending on the unique circumstances surrounding the case. These are often referred to as "wobblers" and it will be in the hands of the prosecuting attorney to determine whether to move forward with misdemeanor or felony charges.
